I. Monster Media & Automation, LLC (also known as Monster Media) is a low voltage installer; certified and insured for low voltage work only. Our training and certifications include CEDIA Installer 1, CEDIA EST II, BICSI RCDD, Home theater calibration, Microsoft A+, Advanced networking, Control4 Installer, and many others. We take pride in offering high quality workmanship in Audio/visual, smart home automation, networking, cameras systems, phones/intercom and other low voltage solutions.

II. Liability: Monster Media & Automation, LLC is trained, certified, and insured in low voltage/communications codes and standards (NEC and TIA). We are not licensed or trained in any kind of electrical work (high voltage over 48volts), framing, structure, engineering, drywall, plumbing, landscape, interior design, glass or stone or other such trades. We may assist in these areas at your request but are limited to following your instructions are not responsible for any damage or issues caused from such instructions. Our work will often require cutting access holes and creating pathways. Monster Media does not repair or patch drywall or other surfaces and it will be left to the customer to repair or contract a qualified person to repair. The maximum liability to Monster Media will never exceed 50% of the invoice amount for the work performed that day (or estimated for that day if over invoice covers multiple days).

III. Removal of valuable items: It is the sole responsibility of the customer to remove fragile or valuable items and materials from the work area and pathways and to clear proper space for our technicians, materials and tools. This type of work frequently require ladders, tools or large boxes in and out of the work area. In leaving obstacles, you are releasing Monster Media from liability and giving authorization for us to relocate or leave the material in the work area or path. Dust may also be created. Artwork, electronics or other items that may be sensitive to dust must be removed for the work areas.

IV. Cost of materials and product availability is subject to change. If prices change prior to ordering materials, the invoice will be updated prior to the final payment to the adjusted prices.

V. Delays: Monster Media & Automation, LLC shall not be liable for any delay, failures, or defaults in performance of this agreement or otherwise in whole or in part, caused by the occurrence of ANY contingency beyond our control.

VI. Monster Media may also substitute for comparable products in case of excessive delays, limited availability or if better solutions become available.

VII. Payment is due in full immediately upon completion of invoice. If additional items are added, a second invoice may be created but payment of the first invoice is due before more work can be performed. If product is backordered or unattainable for any reason, and the rest of the work is deemed complete, the invoice minus the missing product cost will be due in full. Once materials have been provided, a payment to cover those products must be made within 15 days if the invoice has not been been paid in full.

VIII. If payment is not received within 7 days of completed invoice, the payment is considered late. A $50 late fee and 1% interest charge will be applied monthly until paid in full (12% annual interest). (Builders/contractors within 30 days). After 30 days without payment, any discounts offered will be null and void and discounted amount will be added back to the invoice.

IX. If work is stalled and we are unable to schedule work for over 15 days, we may collect payment for the work and materials completed.

X. Limited warranty: a 12-month limited warranty is provided by Monster Media & Automation LLC, from the time that the product is delivered to the customer. All warranties and support are voided if payment is not received in full

XI. Installation is complete when materials have been delivered and installed. Product defects or warranty issues shall not withhold invoice payment.

XII. If you are located more than 25 miles from Alpine, UT. you will be charged a fuel surplus fee

XIII. We accept equipment returns within 30 days of purchase, subject to manufacturer’s return policy. Shipping, handling, and restocking fees will be applied. All sales are final on special orders, and custom and discontinued equipment/products.

XIV. Customer Furnished Equipment. It is assumed that all Customer-furnished equipment is working properly. We are not responsible for its performance, integration, or liability associated with any equipment, wiring, or installations provided by the Customer or third parties.

XV. Discount. We have applied a 3% cash discount to Proposal price for payments made by cash or check or no fee electronic payment. If a payment is made with a credit card, the Proposal price will increase by 3%. If payments are late, any discounts offered will be null and void and discounted amount will be added back to the invoice.

XVI. Delays. Monster Media shall not be liable whatsoever for any delays caused by the Customer or by laborers or subcontractors not employed by or contracted with Monster Media. Should Monster Media be delayed in the completion (or commencement) of its work due to other parties’ delay(s), then Monster Media will be given extensions necessary to compensate for the time lost. If Monster Media is delayed at any time in the progress of the Work by Customer change orders, fire, labor disputes, acts of God or other causes beyond our control, the completion schedule for the Work or affected parts of the Work shall be extended by the same amount of the time caused by the delay.

XVII. Proposals or estimates are valid for 30 days from the time proposal is created.
